These Terms and Conditions govern your use of this site and the information services contained herein which is operated by McDonald's Restaurants of Canada Limited ("McDonald's"). Additional terms and conditions of use applicable to specific areas of this site may also be posted in such areas and, together with these Terms and Conditions, govern your use of those areas. These Terms and Conditions, together with any such additional terms and conditions as well as the Privacy Policy, are referred to as this "Agreement". McDonald's reserves the right, in its discretion, to change or modify all or any part of this Agreement at any time, effective immediately upon notice published on the site. Your continued use of the site constitutes your binding acceptance of these Terms and Conditions, including any changes or modifications made by McDonald's as permitted above. If at any time the Terms and Conditions of this Agreement are no longer acceptable to you, you should immediately cease all use of this site.

RESTRICTIONS ON USE

Material from this site may not be copied or distributed, or republished, uploaded, posted, or transmitted in any way, without the prior written consent of McDonald's EXCEPT: you may download one copy of the material on one computer for your personal, non-commercial home use only, provided you do not delete or change any copyright, trademark, or other proprietary notices. Modification or use of the materials for any other purpose violates McDonald's intellectual property rights. The material in this site is provided for lawful purposes only. If you download software from our site, the software, including all files and images, contained in or generated by the software, and accompanying data (together, the "Software") are deemed to be licensed to you by McDonald's. Neither title nor intellectual property rights are transferred to you, but remain with McDonald's, who owns full and complete title. You may not resell, decompile, reverse engineer, disassemble, or otherwise convert the Software to a human perceivable form.

RESTRICTION OF LIABILITY

McDonald's will not be liable for any damages or injury caused by, including but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure. Unless otherwise expressly stated to the contrary in this site, the limit of McDonald's liability (whether in contract, tort, negligence, strict liability in tort or by statute or otherwise) to you in any manner related to your use of this site, for any and all claims shall not in the aggregate exceed your direct damages up to a limit of Fifty Dollars ($50.00). Notwithstanding the foregoing, in no event shall McDonald's be liable for any of your indirect, special, consequential, incidental or punitive losses, damages or expenses or lost profits or savings even if it has been advised of their possible existence, even if there is negligence or McDonald's or an authorized McDonald's representative has been advised of the possibility of such damages, or both. Any action by you must be brought within two years after the cause of action arose.

All remarks, suggestions, ideas, graphics, or other information communicated to McDonald's through this site (together, the "Submissions") will forever be the property of McDonald's. McDonald's will not be required to treat any Submission as confidential, and will not be liable for any ideas for its business (including without limitation, product, or advertising ideas) and will not incur any liability as a result of any similarities that may appear in future McDonald's operations. Without limitation, McDonald's will have exclusive ownership of all present and future existing rights to the Submission of every kind and nature everywhere. Except as noted below in this paragraph, McDonald's will be entitled to use the Submission for any commercial or other purpose whatsoever without compensation to you or any other person sending the Submission. Any personally identifiable information that may be received at this site is provided voluntarily by the visitor to this site and is subject to the McDonald's Privacy Policy on this site. This Agreement will be governed and be interpreted pursuant to the laws in force in the Province of Ontario, Canada, without regard to its conflict of law principles. If any part of these Terms and Conditions is unlawful, void, or unenforceable, that part will be deemed severable and will not affect the validity and enforceability of any remaining provisions. Possible evidence of use of this site for illegal purposes will be provided to law enforcement authorities. This is the entire agreement between the parties relating to the use of this site. McDonald's products and services are available in many parts of the world. However, the McDonald's site may describe products and services that are not available worldwide. This site may be linked to other sites which are not maintained by McDonald's. McDonald's is not responsible for the content of those sites. The inclusion of any link to such sites does not imply endorsement by McDonald's of the sites.
